The New Hampshire Board of Pharmacy will be holding a hearing on September 25, 2025, at 9:30 am to review the repeal of three rules.  The three rules being repealed are (1) in regard to unused prescription drugs, (2) the New Hampshire Controlled Drug Prescription Health and Safety Program, and (3) Continuous Quality Improvement.  In lieu of attending, written comments can be submitted to OPLC-Rules@oplc.nh.gov.

On July 18, 2024, the Joint Legislative Committee on Administrative Rules is expected to make permanent Pharmacy Code of Conduct regulations that were previously proposed by the Board of Pharmacy. The regulations include a list of eleven ethical standards for pharmacists.

On May 15, 2024, the New Hampshire Senate Committee on Health considered HB 1365, a bill relative to the substitution of biological products by pharmacies. The bill intends to allow for the substitution by a pharmacist of an interchangeable biological product for another interchangeable biological product. HB 1365 had been previously approved by the House. NACDS will remain engaged on this legislation.

The New Hampshire legislature has approved an NACDS supported bill SB 35, a bill that will authorizes pharmacists, pharmacy interns and licensed advanced pharmacy technicians to administer an RSV vaccine to adults. The bill now awaits signature from the Governor.

Governor Sununu (R) signed NH SB 229 into law, expanding the authority of qualified pharmacy technicians to immunize. A pharmacist, pharmacy intern, [or] licensed advanced pharmacy technician, or certified pharmacy technician, under the supervision of an on-site immunizing pharmacist may administer influenza and a COVID-19 vaccine, if available, to the public. A pharmacist, pharmacy intern, or licensed advanced pharmacy technician, under the supervision of an on-site pharmacist may administer Hemophilus influenza, hepatitis A, hepatitis B, hepatitis A and B, human papillomavirus, meningococcal, pneumococcal, tetanus, and diphtheria, varicella, zoster, MMR (measles, mumps, and rubella), and Tdap (tetanus, diphtheria, and pertussis) vaccines, which have been approved by the Food and Drug Administration, to individuals 18 years of age or older as ordered by an immunizing pharmacist. This law goes into effect 90 days after July 27. 

Also in New Hampshire, Governor Sununu (R) vetoed NH HB (House Bill) 1022 which would have permitted Ivermectin to be dispensed via standing order.

The New Hampshire legislature passed SB229 and it is on its way to the Governor for his signature. This measure allows licensed or certified pharmacy technicians to administer vaccines under the supervision of a licensed pharmacist. To administer vaccines, pharmacy technicians must be registered with the board and must have completed training that includes hands-on injection techniques and the recognition and treatment of emergency reactions to vaccines.

The Board of Pharmacy has proposed to adopt regulations to establish requirements for automated pharmacy systems in community long-term care facilities, hospices, state and county correctional institutions, and hospitals. A hearing is scheduled for March 18,2022 in Concord.

This week the New Hampshire State Senate unanimously passed SB (Senate Bill) 229, which will allow a certified pharmacy technician to administer both flu and covid vaccines. The New Hampshire Chain Pharmacy Association testified in support of passage of SB 229. The bill will now move to the House, and it is anticipated that the House Health, Human Services and Elderly Affairs Committee will hold a hearing during the latter half of March or in April.
