Larry Rhoden (R) signed SB 154, legislation prohibiting pharmaceutical manufacturers from interfering in contracts between 340B entities and pharmacies and providing a 340B entity or a pharmacy may file a civil action against a pharmaceutical manufacturer for a violation and may request injunctive relief, actual and consequential damages and reasonable attorneys’ fees and costs.

On March 23, South Dakota Gov. Kristi Noem (R) signed HB 1135; PBM legislation including requirements for PBM licensure, prohibiting retroactive fees except in certain situations and the collection of renumeration fees, and adding criteria for drugs to be placed on the MAC list.
