NACDS reminds members that the long-awaited pharmacy cost of dispensing study required by SB 188 of 2024, a landmark law that will require a pharmacy reimbursement rate floor in the commercial market, has been delivered to pharmacies and is due back by February 28. The study will be used by the Department of Insurance to determine the pharmacy dispensing fee that commercial insurers will be required to pay in combination with NADAC. It is critical for pharmacies to complete this survey, to establish an accurate dispensing fee that sets a precedent for future actions across the states. Data must be submitted electronically through the Board’s Licensure Gateway using Form A (required) and Form B (optional). All community and specialty pharmacies that are open to the public are required to submit their cost of dispensing data using Form A. Medicaid issued bulletin extending the effective date for the Managed Care Organization (MCO) Over-the-Counter (OTC) coverage change to February 15. At that time, the Department for Medicaid Services (DMS) will end coverage for OTC drugs that are non-Medicaid rebateable. The effective date has been extended to ensure providers have adequate time to prepare for this change.

The Cabinet for Heath and Family Services released an extremely positive, in-depth report on parity in pharmacy payment for services. The report is a result of SJR 46, legislation adopted in 2025 that NACDS supported. The report found that paying pharmacies for clinical services would have minimal costs and positively impact access to care. As a result, NACDS intends to work with in-state partners to pass legislation mandating Medicaid payment for services in 2026. 

Also in Kentucky, MedImpact issued an updated list of covered influenza vaccines, effective August 16. As a reminder, MedImpact does not require pharmacies to enroll in the Vaccines for Children program to be eligible for reimbursement.

With dozens of overdose deaths in the state involving bromazolam, Attorney General Russell Coleman (R) is calling on the Cabinet for Health and Family Services (CHFS) to take emergency action to ban the drug. Additionally, he has contacted the US Drug Enforcement Administration asking them to quickly schedule the drug as a controlled substance. The drug has already been scheduled in some states, including Nevada, New Mexico, North Dakota, Virginia and West Virginia.

MedImpact distributed an updated statewide naloxone protocol. Please note that the protocol requires pharmacies to notify the Department for Public Health when initiating participation under the statewide protocol by emailing or faxing (502-564-9377) the signed protocol within seven days of dispensing naloxone. 

Also in Kentucky, MedImpact issued a bulletin detailing NADAC pricing and the process for reversing and refilling claims when drug prices increase. 

Also in Kentucky, the Department of Insurance (DOI) issued Bulletin 2025-03 to provide details regarding its enforcement of SB 188 of 2024, the comprehensive PBM commercial market reform law. As a reminder, the rate floor for chain pharmacies will not be effective until the DOI cost of dispensing study is completed. 

Finally in Kentucky, MedImpact issued a third reminder to pharmacies regarding recent changes to its covered diabetic supplies list.
