The Board of Pharmacy shared an announcement that there is now a statewide standing order for naloxone distribution from pharmacies. Through a standing order issued by Mary S. Carpenter, MD, with the Departments of Health and Social Services, Naloxone can now be requested and dispensed by pharmacists in South Dakota to any person who is: an individual at risk of experiencing an opioid-related overdose; and/or a family member, friend, or close third party to a person at risk of experiencing an opioid-related overdose. The Board of Pharmacy issued a final rule regarding the licensing and oversight of pharmacists, pharmacy interns, registered pharmacy technicians, and pharmacies, including central fill pharmacies. The rule is effective October 12, 2020.

NACDS participated in a meeting of a committee comprised of representatives from the Board of Pharmacy, Board of Nursing, and Board of Medical and Osteopathic Examiners. Applicable South Dakota statutes require this group to address pharmacist immunization standards. The committee agreed to allow the Board of Pharmacy’s immunization rule language to proceed. The Board of Pharmacy anticipates holding an August meeting to engage in discussions on the broader rule package shared with members previously.

Gov. Kristi Noem (R) signed into law HB 1137 effective Monday, July 1. Among its provisions, the measure prohibits pharmacy benefit managers from collecting cost-sharing in a great amount than the covered individual would pay for the drug. It also prohibits pharmacy benefit managers from retroactively adjusting a pharmacy claim unless it is a result of an audit or a technical billing error.
