Washington
The Pharmacy Quality Assurance Commission (PQAC) is conducting an accessible labeling capability assessment survey to assess current pharmacy practices around providing accessible labeling options to patients, including whether such options are already made available, and what technological, financial, or resource-based obstacles prevent such options from being offered. PQAC filed a rulemaking inquiry (CR-101) to consider new and amended rules related to prescription label accessibility standards on issues pertaining to both visual/print disability access and the translation of prescription drug information for individuals for whom English is not a primary language.

Georgia
Beginning this week, the Georgia Department of Human Services (DHS) will provide cash assistance of up to $350 for active enrollees in Medicaid, PeachCare for Kids, SNAP (Supplemental Nutrition Assistance Program), and/or TANF government benefit programs.
Georgians with email addresses registered with DHS will receive virtual payments by eGift card, this is separate from current benefit payment cards. Plastic cards will be mailed to eligible Georgians who do not have their email address listed in Gateway.
The virtual payment card is a Mastercard prepaid card that works exactly like a debit card – and will live in the recipient's digital wallet (Apple, Google, Samsung Wallets). The virtual payments can also be used via keyed entry anywhere that accepts Mastercard payments, not just online.

Indiana
The Family and Social Services Administration's (FFSA) Indiana Health Coverage Programs (IHCP) announced that they will continue reimbursing Health Indiana Plan (HIP) services at Medicare rates through the end of 2023. However, January 1, 2024, they will transition to a reimbursement model with consistent rates across all its programs. IHCP plans to equalize rates among the HIP, Hoosier Care Connect, Hoosier Healthwise and fee-for-service programs.
Also in Indiana, IHCP will host an online seminar on September 28 to discuss provider notices published this month.
Also in Indiana, IHCP announced the intent to implement Statewide Uniform Preferred Drug List (PDL) for all Medicaid pharmacy plans effective July 1, 2023.

Kentucky
As a result of the adoption of an Emergency Administrative Regulation, beginning October 1, 2022, MedImpact will pay pharmacies a dispensing fee of $10.64 for each prescription of Suboxone every 7 days, as written by the prescriber. Prior to the adoption of the new regulation, Medicaid would only pay the fee every 23 days. This will be practically implemented as one dispensing fee and up to three additional professional service fees per rolling 28-day period. To receive the professional service fees, the pharmacist is required to take additional steps, including checking KASPER and providing patient counseling. Also in Kentucky, The Board of Pharmacy has issued the following proposed rules for public comment. Comments are due to the BOP on November 30 and contact details are on the last page of each rule.
- 201 KAR 030 – amends to the license transfer regulation to establish a non-resident pharmacist license for any pharmacist located outside of Kentucky serving Kentucky patients; requires the pharmacist to have a non-resident pharmacist license and participate in NABP's Verify program; exempts the non-resident pharmacist from continuing education requirements in the state
- 201 KAR 2 460 -establishes an out-of-state pharmacy permit
- 201 KAR 2 360 – amends the Naloxone regulation allowing pharmacists to dispense to emergency departments under a protocol

Louisiana
The Department of Health’s (LDH) deadline for Medicaid providers to submit an enrollment application is September 20, 2022. Claims will be denied beginning December 31, 2022, for providers who have not completed the enrollment process by September 30. Providers should visit www.lamedicaid.com to enroll. Michigan
On September 19th, the state authorized delegated pharmacists to have prescriptive authority to prescribe self-administered hormonal birth control— including oral contraceptives, the patch, and the ring. The action allows pharmacists to opt into this program but does not require participation. The change happened under an interpretive statement (see attached) issued by the state’s Licensing and Regulatory Affairs Department (LARA) under the direction of a previous executive directive 2022-05 Gov. Whitmer issued in May this year. Pharmacists must enter into a delegation agreement prior – a sample delegation agreement is available on LARA’s website and attached. The governor’s executive directive in May instructed state departments and agencies to identify and assess opportunities to increase protections for reproductive health care. At the September Board of Pharmacy meeting, Board members voted against extending a temporary emergency regulation re-instating the 6:1 pharmacy technician to pharmacist ratio that expired in July of 2022.

North Carolina
on December 1, 2022, North Carolina will launch the NC Medicaid Managed Care Behavioral Health and Intellectual/Developmental Disabilities Tailored Plans. “This plan is an integrated health plan for individuals with significant behavioral health needs and intellectual/developmental disabilities (I/DDs)” On October 12, 2022, at 8:00 am EST NC Medicaid will host an online seminar to provide valuable information about each of the contracted Tailored Plan managed care organizations, and to provide an opportunity for pharmacists to ask questions about what to expect, operational changes and processes. The target audience for the Webinar includes pharmacy owners, managers and those who submit pharmacy benefit claims for Medicaid beneficiaries.

New York
The Medicaid Department updated the Medicaid Fee-for-Service Providers Dispense Brand Name Drug when Less Expensive than Generic Program.
Effective 10/6/2022, the following changes will be made to the Dispense Brand Name Drug
When Less Expensive Than the Generic Program:
- Daytrana, Nexavar, Pradaxa and Ventolin HFA will be ADDED to the program
- ProAir HFA will be REMOVED from the program.
In conformance with State Education Law, which intends patients receive the lower cost drug
alternative, brand name drugs included in this program:
- Do not require 'Dispense as Written' (DAW) or 'Brand Medically Necessary' on the
prescription.
- Have a generic copayment.
- Are paid at the Brand Name Drug reimbursement rate or usual and customary price,
whichever is lower (SMAC/FUL are not applied).
- Do not require a new prescription if the drug is removed from this program.
IMPORTANT BILLING INFORMATION
Pursuant to this program, prescription claims submitted to the Medicaid program do not require the submission of Dispense as Written/Product Selection Code of '1'; Pharmacies should submit DAW code 9 (Substitution Allowed by Prescriber but Plan Requests Brand). Pharmacies will receive a NCPDP (National Council for Prescription Drug Programs) reject response of "22" which means missing/invalid DAW code if other DAW codes are submitted. The only exception to this, is DAW code 1 and "Brand Medically Necessary" on the prescription.

Ohio
NACDS reminds members that at midnight on Saturday Oct. 1 the state's SPBM (Single Pharmacy Benefit Manager), Gainwell, will being processing managed care pharmacy claims. Beginning October 1, pharmacy benefits for managed Medicaid members will be covered by the Single Pharmacy Benefit Manager (SPBM), Gainwell Technologies. Gainwell's provider manual, also known as the pharmacy reference guide, is the primary resource guide providing key information to pharmacy providers, pharmacy support staff, and prescribers. The provider manual includes information related to pharmacy claims submission, reimbursement rates, pharmacy network requirements, the specialty pharmacy program, claims processing, utilization management, and prior authorization. The Oregon Health Authority announced Nevada has jointed Oregon and Washington to offer the ArrayRx Card, a prescription discount card, formerly referred to as the Oregon/Washington Prescription Discount Card.

Pennsylvania
Due to recent technical issues with the Pennsylvania Licensing System (PALS) website, the Board of Pharmacy announced that the renewal period for Pharmacist Licenses and Authorizations to Administer Injectables for Pharmacists, has been extended to October 31, 2022. The renewal extension does apply to CE (Continuing Education) credits. However, if licensees earn CE between October 1- 31, 2022, to use for the 2022 license renewal, they cannot count those same CE credits toward the 2024 license renewal. The Select Committee on Health Care Reform is meeting on October 3rd to examine the potential impact of delayed care on the state’s health care delivery system, health care costs, and patient health outcomes. They will also study delays during the pandemic in obtaining preventive and primary health services, such as well-childcare, prenatal care, screenings for cancer and chronic disease, behavioral health, urgent care, chronic illness, and immunizations.

Virginia
The Board of Pharmacy has posted the draft minutes from the September 6 meeting. Note that they approved emergency regulations to comply with treatment provisions passed into law in 2022 under HB (House Bill) 1323 that allows pharmacists to prescribe tobacco cessation medications. Specifically, they approved the changes to apply to all current statewide protocols reflecting new requirements under HB 1323 and added tobacco cessation treatment to the permitted protocols. Additionally, the board proposed amendments to its workforce regulations pursuant to HB 1324.

Alabama
All previously published expiration dates related to the COVID-19 public health emergency (PHE) are once again extended by the Alabama Medicaid Agency (Medicaid). The new expiration date is the earlier of October 31, 2022, the conclusion of the COVID-19 national emergency, or any expiration date noticed by the Alabama Medicaid Agency through a subsequent ALERT.
Medicaid is preparing now for the end of the COVID-19 PHE. Medicaid partners can assist in relaying a consistent and simple message to the Medicaid recipients by sharing key messages from the Agency in your newsletters, social media posts, and other means of communication. Also in Alabama, effective October 1, 2022, the Alabama Medicaid Agency will remove prior authorization (PA) from levalbuterol tartrate HFA (generic Xopenex HFA). Brand Xopenex HFA will now require PA and update the PDL (Preferred Drug List) to reflect the quarterly updates listed here.
