Georgia
This week, the Georgia Board of Pharmacy issued two emergency orders dealing with Delivery by Mail and Remote Order Verification. Governor Kemp has also issued an Executive Order reducing certain regulations to stop the spread of COVID-19, of interest is 90 Day supply without physician authorization, early refill authorization, temporary licensure.

Indiana
Several bills of interest to pharmacy saw action this week:
SB 241: This bill was signed by Gov. Eric Holcomb (R) on March 18th and sponsored by Sen. Liz Brown (R). The law will help ensure that that pharmacies are fairly and properly reimbursed by requiring pharmacy contracts to have clearly defined drug pricing and reimbursement methodologies and audit practices. It also prohibits directly or indirectly retroactively denying a claim or aggregate of claims after the claim or aggregate of claims has been adjudicated and allows pharmacies to contest changes in their reimbursement. It also requires the maintenance of adequate pharmacy networks to provide beneficiaries with equal access to all network pharmacies. NACDS applauds the work of the Indiana Pharmacists’ Association on this law.
HB 1207: This bill, which addresses both copayment and scope of practice issues was signed by Gov. Eric Holcomb (R) on March 18 and authored by Rep. Steven Davisson (R). The law prohibits payors from requiring a pharmacy to collect a higher copayment for a prescription drug from a patient than the plan allows the pharmacy or pharmacist to retain. On the scope of practice front, effective July 1, 2020, it will allow pharmacists to furnish epinephrine by standing order. Additionally, it will allow pharmacy technicians to provide influenza vaccines and transfer certain prescriptions.

Iowa
The Iowa Board of Pharmacy has issued COVID-19 guidance to pharmacies about its enforcement of administrative rules and published a document with Frequently Asked Questions.

Kentucky
The General Assembly passed SB 50 sponsored by Sen. Max Wise (R). The bill will provide significant financial relief to pharmacies by prohibiting PBMs in Medicaid managed care from using fees or effective rates to lower reimbursement. Additionally, the bill will require the Department of Medicaid Services, with the input of pharmacy, to set reimbursement rates in Managed Care. The intent of this provision is to move to cost-based reimbursement plus a professional dispensing fee. NACDS supported the on-the-ground efforts of the Kentucky Retail Federation and member companies to support provisions of this bill that align with our campaign. The bill now goes to the Governor.

Louisiana
After seeing several Emergency Orders allowing early refills, 90-day supply for maintenance medications, extending prior authorizations and waving copays, NACDS reached out to the Department of Health’s Medicaid and Pharmacy staff requesting that they consider additional COVID19 waivers. NACDS shared model language to access essential services at pharmacies, including encouraging the Department of Health to adopt a statewide protocol to allow pharmacists to test and treat for COVID-19 once the anti-viral comes to market. We also discussed 1135 waivers and their pending SPA which will allow pharmacists to be reimbursed for adult immunizations.

Also in Louisiana... Prior to the postponement on the March 18th Board of Pharmacy’s Regulation Revision Committee meeting, NACDS submitted a comment letter on the telepharmacy rules, urging the Board to remove the arbitrary restrictions on location of dispensing sites, prescription volume, and staffing requirements.
Also in Louisiana... The April 7, 2020 Pharmacy Legislative Day at the Capitol has been cancelled.

Mississippi
The Reeves Administration has announced temporary Medicaid changes in response to coronavirus outbreak. Missouri
After receiving authority from Missouri, Gov. Mike Parson’s (R) Executive Order to address regulatory burdens impeding response to the COVID-19 pandemic, the Board of Pharmacy has waived a number of regulations, which can be found on a dedicated web page, along with materials from this week’s webinar. The Missouri Pharmacy Association is hosting another webinar (open to non-members) on Friday, March 27, 2020 at 12 pm.

New Mexico

Nevada
Governor Steve Sisolak (D) signed an emergency regulation promulgated by the Board of Pharmacy aimed at preventing hoarding of the drugs. The regulation prohibits the prescribing and dispensing chloroquine and hydroxychloroquine for a COVID-19 diagnosis, requires an ICD-10 code on prescriptions for the drugs and limits the prescription amount to a 30-day supply for the drugs.

North Dakota
Gov. Doug Burgum (R) directed state agencies to provide recommendations for policies hindering response to the COVID-19 pandemic. In another Executive Order, he directed pharmacy benefit management companies to eliminate proof of delivery requirements; authorized license pharmacists to administer COVID-19 testing; and authorized emergency refills of non-controlled substances for up to 30 days. The Department of Human Services has created a Medicaid pharmacy document of Frequently Asked Questions.

Oklahoma
NACDS submitted comments to the State Bureau of Narcotics and Dangerous Drugs Control (OBNDD) on proposed rule changes pertaining to the information that pharmacies are required to report to Oklahoma’s prescription drug monitoring program (PDMP). The letter recommended that the data pharmacies are required to report should be limited to information that is required to be on a controlled substance prescription and/or required to process third party claims. NACDS also commented that costly software changes would be needed for pharmacy dispensing and management computer systems to accommodate the reporting of added data elements.

Oregon
NACDS submitted a formal request to the Oregon Board of Pharmacy asking them to delay enforcement of Senate Bill 698 – Translation labelling – Until July 2022. The Board has not developed rules for implementation, delaying members’ ability to work with IT for changes that will be needed to label prescriptions in English and the patient’s preferred language.

Pennsylvania
Gov. Tom Wolf (D) has announced new measures allowing healthcare professionals, including pharmacists, to re-enter the workforce to assist with the COVID-19 crisis. Specifically, pharmacists whose licenses are expired/inactive for less than four years can apply for reactivation of their licenses. Their CE requirements and license reactivation fees will be suspended. Governor Bill Lee (R) has issued Executive Order #15. Of note to pharmacy practice, the following items have been addressed to promote the health and well-being of Tennesseans during the COVID-19 pandemic: Out-of-State Licensed Health Care Professionals, Refills of Maintenance Medications up to 90 Days, Patients in Temporary Residences, Expiration of Health Care Professionals and Facilities Licenses, Remote Verification of Prescriptions Certificate of Need Requirements, Alternate Testing Site Allowance, Setting Prices on Medical Supplies, Emergency Supplies, or Consumer Food Items, TennCare Changes and Tennessee Department of Commerce and Insurance.

NACDS has been sharing our model language for COVID19 waiver requests with our in-state partners to promote with the state agencies. The Texas Federation of Drug Stores (TFDS) utilized these documents and submitted numerous waiver requests and authorizations from regulations to Gov. Greg Abbott (R), the Board of Pharmacy and the Department of Insurance.
Also in Texas... The Board of Pharmacy held an emergency board meeting on March 20th to adopt rules placing limits on dispensing of chloroquine, hydroxychloroquine, mefloquine, or azithromycin. Also in Texas... Gov. Greg Abbott (R) ordered the creation of a temporary Supply Chain Strike Force tasked with guiding collaboration between the public and private sectors to ensure health care facilities have the supplies and resources they need to respond to COVID-19. Wyoming

The Iowa state legislature suspended its session for a minimum of thirty days as of March 16th out of concern for the COVID-19 pandemic. The Iowa Board of Pharmacy issued guidance for pharmacies with limited supplies of compounding garb.
