Emergency rule of the Medical Board adopts regulations under 21 NCAC 32B to establish the restricted drug list during the new coronavirus (COVID-19) public health emergency. The rule also establishes standards for pharmacists to receive and document oral prescriptions for restricted drugs. The rule is effective April 6, 2020 and expires June 5, 2020.

Gov. Doug Burgum (R) directed state agencies to provide recommendations for policies hindering response to the COVID-19 pandemic.  In another Executive Order, he directed pharmacy benefit management companies to eliminate proof of delivery requirements; authorized license pharmacists to administer COVID-19 testing; and authorized emergency refills of non-controlled substances for up to 30 days.  The Department of Human Services has created a Medicaid pharmacy document of Frequently Asked Questions.

The law allows pharmacists to initiate/modify drug therapy pursuant to established protocols, authorizes a pharmacist to furnish different types of medications, and eliminates some of the administrative requirements for collaborative practice agreements.

Gov. Doug Burgum (R) signed into law HB 1498 effective Monday, August 1. This bill revises the current law that allows pharmacists to administer drugs by eliminating language specifying the prescribing practitioner type who can authorize pharmacist administration pursuant to an order; more broadly allowing for the provision of drugs to patients pursuant to a written order; and modifying the education requirements for pharmacists who provide these services, eliminating the requirement for 20 hours minimum education, six hours  of continuing education and education on how to educate patients on the need for immunizations.
