The Board of Pharmacy has announced that it has scheduled a special videoconference board meeting on November 10, 2020. Additionally, the Board will consider at their December Board meeting rules (Notice) that would remove administrative restrictions on pharmacies, pharmacists, and off-site pharmaceutical providers.

As a result of efforts by NACDS, the Retail Association of Nevada (RAN), and our chain pharmacy members, permanent rules passed by the Board of Pharmacy allowing pharmacy technicians to administer vaccinations last month were fast-tracked and received administrative approval in weeks rather than months. Also in Nevada. The Department of Health and Human Services, Board of Pharmacy, and Immunize Nevada will be hosting a teleconference regarding COVID-19 Vaccines on October 22, 2020, at 2 PM PT. The aforementioned state entities have stated that they appreciate the commitment of pharmacists to play a vital role in administering COVID immunizations, when available and that the goal of the meeting is to initiate a dialogue between the Nevada Department of Health and Human Services and pharmacists by providing an update on vaccine preparations and answering common questions the state has received regarding the vaccine.

Gov. Steve Sisolak (D) signed the Board of Pharmacy’s emergency rule authorizing trained pharmacy technicians to administer immunizations under the direct supervision of a pharmacist in response to the COVID pandemic. Efforts are also underway to ensure the quick adoption of a permanent rule approved by the Board.

After six months of engagement, NACDS has secured broad support from the Nevada Department of Health, Gov. Steve Sisolak’s (D) office, and the Board of Pharmacy regarding authority to allow technician immunizations. On September 3 the Board adopted a proposed rule allowing pharmacy technicians to administer immunizations under the direct and immediate supervision of a pharmacist if he or she has met the training and continuing education requirements. Additionally, due to the lengthy rulemaking process which can take up to 4-6 months, the Board also approved the adoption of emergency rules including these same provisions and authority that  appear to go into effect before the end of September.

The Board of Pharmacy issued a proposed rule to amend regulations under NAC 453 adding certain substances to schedule I; providing that certain drug products that contain CBD are not a controlled substance; removing certain drug products that contain CBD from the list of controlled substances on Schedule V, and providing other matters properly relating thereto. Comments on these proposed changes will be accepted but no due date has been specified by the state.

Also in Nevada. On August 6, the legislature adjourned the 6-day special session. Only 11 bills were passed, most notably a bill expanding access to mail-in ballots for the November general election, providing limited liability protections from COVID for businesses, and certain government entities and non-profit organizations.

NACDS and the Retail Association of Nevada’s (RAN’s) chain pharmacy members held a call with the Board of Pharmacy Executive Secretary Dave Wuest, who has agreed to move forward with plans to advance a regulation regarding pharmacy technicians administering immunizations at the September 3, 2020, in-person Board meeting in Reno.  In addition to adopting permanent rules, the Board plans to pursue the adoption of a temporary regulation using the same language in the permanent regulation, which would serve to bridge the gap until the permanent language is adopted. Lastly, Mr. Wuest informed chain members that he will ask the Board to approve the same language as a non-renewable emergency regulation that would become effective immediately upon filing with the Secretary of State, but will only be effective for 120 days. RAN and NACDS will continue to work closely with the Board to move this language forward in anticipation for the upcoming flu season and release of a vaccine for COVID-19.
