On May 3, Kristin K. Mayes, Attorney General, added her signature to the Board of Pharmacy’s emergency rules allowing a pharmacy technician to administer a vaccine when the technician has completed specified training and the authority to administer the vaccine is delegated by and under the supervision of the pharmacist on duty. The rule will be effective when filed with the Office of the Secretary of State.

On April 18, Gov. Katie Hobbs (D) signed SB (Senate Bill) 1382 (Chapter 74), legislation requiring PBMs to obtain a certificate of authority to operate and outlining the role, responsibilities and authority of the Department of Insurance and Financial Institutions. 

Also in Arizona, the Board of Pharmacy scheduled Oral Proceeding/Public Comment RE: Prescribing a Self-Administered Hormonal Contraceptive on May 16 from 9:00 a.m.-10:00 a.m. 

Finally in Arizona, the Board of Pharmacy Oral Proceeding/Public Comment RE: Technician Immunization Authority on May 22 at 9:00 a.m.

SB 1283, legislation requiring PBMs to obtain a certificate of authority to operate and outlining the role, responsibilities and authority of the Department of Insurance and Financial Institutions, was heard in the House Regulatory Affairs Committee on March 22 where is was amended and voted (6-1) with “Do Pass Amended”.

Gov. Katie Hobbs (D) vetoed SB (Senate Bill) 1248, legislation repealing several components of the sunrise process for scope expansion, including pharmacy. 

Also in Arizona, on March 6, SB 1254 (Senate Engrossed), legislation repealing the requirement for a Schedule II opioid prescription that is directly dispensed by a pharmacist and that is not for the immediate administration to the ultimate user to have a red cap, failed to pass the House Health and Human Services Committee by a 3-4 vote.

SB 1248, legislation repealing several components of the sunrise process for scope expansion, including pharmacy, passed the Senate (21-9) and the House (42-18) and was sent to the Gov. Katie Hobbs (D) for signature. The sunrise process will require material changes to certification, registration, or licensure. 

Also in Arizona, on February 20, SB 1254 (Senate Engrossed), legislation repealing the requirement for a Schedule II opioid prescription that is directly dispensed by a pharmacist and that is not for the immediate administration to the ultimate user to have a red cap, passed the Senate and was transmitted to the House.

SB 1460, permitting pharmacists to test and treat for influenza, a respiratory infection and a condition related to a public health threat by the Department of Health Services for which a statewide standing order, rule or executive order is issued, will not advance this year. Stakeholder meetings will take place in the interim in preparation for legislation in 2024.
