Texas
On September 1, 2023, more than 770 new laws passed by the legislature go into effect, including Senate Bill 29 that bans the state from enacting mask mandates, vaccine mandates or business and school closures to prevent the spread of COVID-19. The law makes exceptions for certain entities, such as prisons, hospitals and assisted living centers or nursing homes.
Also in Texas, NACDS sponsored the Passing of the Gavel ceremony where HEB pharmacist Jay Bueche was sworn in as president of at the Texas Pharmacy Association's (TPA) Convention and Expo in Houston.
Also in Texas, the Health, and Human Services Commission (HHSC) Vendor drug program provided several updates of interest to pharmacies:

Alabama
The Board of Pharmacy and the Board of Medical Examiners held a Joint Committee meeting to discuss the issue of test and treat in community pharmacies. Both Boards have made the decision to begin the rulemaking process to amend our rule to allow for test and treat under certain conditions. To learn more about what conditions must be met before beginning test and treat, you can view the drafted language on the Board of Pharmacy’s website (under “Resources;” select “Statutes & Rules”) once stamped by LSA (Legislative Services Agency). Also in Alabama, emergency rule 680-X-2-.49.01ER Remote Work by Pharmacists is currently in place until October 29, 2023. The permanent rule is currently in the rulemaking process.

Arizona
The Board of Pharmacy posted a notice announcing “[t]he online renewal cycle will begin on September 5, 2023, at 00:01 MST and end on November 1, 2023, at 23:59 MST. Renewals submitted after November 1, 2023, are subject to a late renewal penalty. You may renew it by logging into your online profile. Please note: A person shall not apply for a license renewal more than sixty days before the expiration date of the license.”

Colorado
The Department of Regulatory Agencies (DORA) will hold a stakeholder webinar at 1:00 p.m. MT on August 21 to discuss several proposed rules, including:
- Rule 23.00.70 – ELECTRONIC PRESCRIPTION MONITORING PROGRAM – Release of PDMP (Prescription Drug Monitoring Program). Information – The purpose of the proposed amendments to Board Rule 23 is to reflect feedback from several stakeholders and board members to clarify records requests for deceased individuals.
- Rule 3, 11, 17, 20, and 21 – DISPENSING, RECORDS AND RECORDKEEPING, COLLABORATIVE PHARMACY PRACTICE, CENTRAL PRESCRIPTION PROCESSING, and COMPOUNDING – The purpose of the proposed amendments to Board Rule 3, 11, 17, 20, and 21 are to reflect feedback from several stakeholders and board members to bring our rules up to date with digital technology and other outlet protocols and other recordkeeping means through digital formats.

Connecticut
During this year’s legislation session, Connecticut Public Act 23-19 was passed, and pharmacists are now allowed to vaccinate children ages 12 years and up. Regulations are expected to be adopted by the Department of Consumer Protection, in consultation with the Commissioner of Public Health and the Commission of Pharmacy. While regulations and legal questions are worked through, the Department of Public Health (DPH) Immunization Program would like to assist you with enrollment in the Connecticut (Pediatric) Vaccine Program (CVP). Per CGS Sec. 19a-7f, all vaccines administered to children in Connecticut available through the CVP must be procured through the Immunization Program.

Illinois
HB 3203, legislation that authorizes pharmacists or retailers to sell fentanyl test strips over the counter and authorizes county health departments to distribute fentanyl test strings at their facilities for no fee was signed by Gov. JB Pritzker (D) on August 4th and goes into effect January 1, 2024.
Also signed by Gov. Pritzker (D) on August 4th was HB 3631, legislation that prohibits a pharmacy benefit manager (PBM) from retaliating against a pharmacist or pharmacy for disclosing information in a court, administrative hearing, before a legislative commission or committee, or any proceeding, if the pharmacist or pharmacy has reasonable cause to believe that the disclosed information is evidence of a violation of state or federal law, rule or regulation. The bill also prohibits a PBM from retaliating against a pharmacist or pharmacy for disclosing information to a government or law enforcement agency, if the pharmacist or pharmacy has reasonable cause to believe that the disclosed information is evidence of a violation of state or federal law, rule, or regulation. A pharmacist or pharmacy must make reasonable efforts to limit the disclosure of confidential and proprietary information. This measure went into effect July 1, 2023.
Also in Illinois, the Illinois Department of Healthcare and Family Services (HFS) has issued notice that implements Public Act 102-1051 which allows pharmacists to be reimbursed for human immunodeficiency virus (HIV) pre- and post-exposure prophylaxis assessment and consultation. This new policy is effective with dates of service on and after January 1, 2023, and applies to the Medicaid fee-for-service (FFS) program and the HealthChoice Illinois (HCI) managed care organizations (MCOs).
In accordance with the Act, the Department of Healthcare and Family Services (HFS) will cover patient care services provided by a pharmacist for HIV pre- and post-exposure prophylaxis assessment and consultation at 85% of the physician rate. Pharmacists must have a standing order with an associated physician, be licensed to practice medicine in all its branches and be enrolled in the Illinois Medical Assistance Program to perform the assessment and consultation services.
HFS has also issued notice informing pharmacies that HFS has opened additional procedure codes that may be billed for pharmacists providing hormonal contraceptive assessment and consultation services. This applies to the Medicaid fee-for-service (FFS) program and the HealthChoice Illinois (HCI) managed care organization (MCO) plans.
By provider notice dated October 31, 2022, the Department of Healthcare and Family Services (HFS) notified providers that patient care services provided by a pharmacist for hormonal contraceptive assessment and consultation would be covered at 85% of the physician rate. HFS identified CPT procedure code 99401 – Preventive medicine counseling and/or risk factor reduction intervention(s) provided to an individual (separate procedure); approximately 15 minutes, for billing. Modifier FP must be billed in conjunction with procedure code 99401.
Effective retroactive to August 1, 2022, pharmacies may bill on behalf of pharmacists for one of the following Evaluation and Management procedure codes with the FP modifier, in addition to 99401, for the assessment component of the family planning service.
HFS has been notified of an extreme shortage of Cisplatin, which has been determined to constitute a medical emergency for those patients in need. In accordance with the actions by the Food and Drug Administration (FDA), a non-FDA approved Cisplatin, manufactured by Qilu Pharmaceutical Company in conjunction with Apotex Corporation, can be distributed into and within the State of Illinois and will be reimbursable for Illinois Medicaid enrolled providers. Finally in Illinois, Snap EBT (Electronic Benefit Transfer) data theft has been on the rise in stores across the Country. The Department of Human Services (IDHS) has confirmed a recent surge in compromised cards in Illinois. Retailers are urged to immediately contact their POS (Point of Sale) vendor, local police, FNS and IDHS if skimming devices are discovered, or your pin pads have been compromised in any way. With prompt notification, IDHS can move to protect cardholders before their benefits are stolen. Tracking skimming after the theft is exceedingly difficult to do. Recognized by her peers from across the state as someone dedicated to the advancement of the profession of pharmacy, Jennifer Dupree, RPh with Walmart, was honored by NACDS at the Louisiana Pharmacists Association's annual meeting as the 2023 Louisiana Chain Pharmacist of the Year.

Maine
The Maine legislative session just ended this week with two pharmacy bills left unfunded on the appropriations table, which means they will be reconsidered in the 2024 session. The two bills were LD 1558, a bill that would ban pharmacies from selling most tobacco products, and LD 275, a bill that would study the workplace treatment of pharmacists.

Massachusetts
On August 14, MassHealth asked all pharmacies to post the following document on display in regard to Medicaid eligibility redetermination.
MassHealth also posted an update to COVID vaccine reimbursements and accepted codes in the August provider bulletin.
The Board of Pharmacy updated its policy to allow for RSV (Respiratory Syncytial Virus) vaccines for adults 60 years of age and older. Qualified pharmacy personnel may administer an FDA-approved RSV vaccine if the following conditions are met:
- it is only administered in accordance with the manufacturer's FDA-approved labeling for the specific product; and
- all requirements of Policy 2023-02: Vaccine Administration are met, including a prescription, or standing order.

Missouri
Gov. Gov. Mike Parson (R) appointed two new pharmacists to the Board of Pharmacy, Darren Harris, and Tammy Thompson, replacing Pamela Marshall and Christina Lindsay whose terms had expired.
Also in Missouri, the Department of Social Services (DSS) launched a public dashboard at https://dss.mo.gov/mis/clcounter/ to provide transparency regarding the resumption of eligibility determinations for MO HealthNet, Missouri's Medicaid program. The dashboard displays data for annual renewals due at the end of June. DSS plans to update the dashboard each month.

Nebraska
The Department of Health and Human Services Division of Children and Family Services, Economic Assistance issued will be issuing Pandemic Electronic Benefits Transfer (P-EBT) benefits to Nebraska households on August 15 for school-age children eligible for free or reduced-price school meals during the second half of the 2022-2023 school year period.
Also in Nebraska, the Department of Health and Human Services posted the Medicaid provider fee schedule for Durable Medical Equipment, Medical Supplies, Orthotics and Prosthetics July 1, 2023 (REVISED 8.16.23).

Nevada
The Board of Pharmacy’s agenda for the September 6-7 meeting should be posted here soon. On September 7, there will be a public hearing on a proposed rule requiring a facility for treatment with narcotics to obtain a license and pay a fee to administer opioid agonist treatment medication. It also requires a dispensing practitioner at such a facility to obtain informed consent before reporting certain information.

New Mexico
The State Ethics Commission reached a settlement agreement between Gov. Michelle Lujan Grisham (D) and the New Mexico Human Services Department over a terminated request in January of 2023 for proposals (RFP) for the Turquoise Care Medicaid program. Five managed care organization contractors responded to the RFP and all but one, Western Sky Community Care, was awarded the RFP.

North Carolina
The Board of Pharmacy issued updated guidance on immunization authority for pharmacists, pharmacy technicians and pharmacy interns. This updated guidance relates to legislation initiated in the 2023 Legislative Session (SB 206 and HB 190).

Oklahoma
Gov. Greg Stitt (R) appointed pharmacist Greg Huenergardt to the Board of Pharmacy, effective July 1, 2023, replacing Dr. Justin Wilson.
Also in Oklahoma, CMS sent the Health Care Authority (OHCA) Board a SPA (State Plan Amendment) approval letter confirming that Medicaid recognizes pharmacists as healthcare providers and will reimburse for services they provide within their scope of practice pursuant to state law, including but not limited to administration of any vaccinations or immunizations recommended by the Advisory Committee on Immunization Practices (ACIP).
Also in Oklahoma, the Office of the Insurance Commissioner issued Bulletin 4-2023 detailing the new legislative requirements of Step Therapy Protocol and Biomarker testing (HB 1736, HB 2748, and SB 513).
Finally in Oklahoma, Insurance Commissioner Glen Mulready (R) provided an update on the resolution of the Caremark 90-day prescriptions.

South Carolina
Due to recently enacted legislation, South Carolina retailers who sell tobacco products must notify the Department of Revenue (SCDOR) by August 14, 2023. The legislation, signed into law May 16, updates the definition of "tobacco products" to include cigarettes, products made of tobacco, electronic smoking devices, e-cigarettes, e-cigars, e-pipes, vape pens, e-hookah, e-liquid and tobacco items that may or may not contain nicotine. Texas
The Pharmacy Provider Procedure Manual (PPPM) was updated on August 1, 2023. The revised manual is a comprehensive resource for Medicaid pharmacy providers enrolled with the Health and Human Services Commission's (HHSC) Vendor Drug Program (VDP) on benefits, policies and procedures for outpatient pharmacy claims and rebates.
Also in Texas, NACDS sponsored the Texas Pharmacy Association's (TPA) Conference and Expo in Houston, where Rep. Four Price (R-Amarillo), the author of legislation would have made permanent in Texas law the expanded vaccination authority afforded to pharmacists and pharmacy technicians by the federal PREP (Public Readiness and Emergency Preparedness) Act, gave the keynote address. NACDS also sponsored the Passing of the Gavel ceremony where pharmacist Jay Bueche with HEB was sworn in as president of TPA.

Vermont
NACDS joined its members, in-state partners, and representatives from the state medical community to discuss pharmacist and technician scope with members from the Department of Health. Stakeholders also met on July 27 to discuss test and treat legislation for 2024.
Also in Vermont, on July 26, the Board of Pharmacy held its regular meeting, during which it reviewed the emergency declarations and the Executive Order regarding pharmacies. Link to the agenda
Finally in Vermont, the Executive Order allows a one-time 30-day maintenance prescription to be filled, as well as emergency licensing for pharmacists and pharmacy technicians from out-of-state to fill any staffing gaps. This Executive Order lasts for 90 days or if there is a State of Emergency, whichever is shorter. There will be updates to come as things change. The next board meeting is August 23.

Alaska
HB 112, signed by Gov. Mike Dunleavy (R), requires that Out-of-State Pharmacies be licensed rather than registered by June 30, 2024.
- If an Out-of-State Pharmacy is currently registered, it will not need to do anything until renewal time, which is scheduled for June 2024.
- If an Out-of-State Pharmacy is not currently registered, they will need to apply to be licensed rather than registered beginning November 27, 2023.
- All Internet-based/Online Pharmacies will fall under the same statutory and regulatory requirements as Out-of-State Pharmacies if they want to provide pharmacy services.
- Beginning November 27, 2023, all licensed Out-of-State Pharmacies must also have a Pharmacist-in-Charge that holds an active Alaska Pharmacist license. Out-of-State Pharmacies that are currently registered and will renew in June 2024 must have a Pharmacist-in-Charge that holds an active Alaska Pharmacist license at renewal time.
