Gov. Brian Kemp (R) declared a State of Emergency ahead of the impact of Hurricane Idalia. The Board of Pharmacy has issued a statement seeking to remind pharmacy licensees in this time of emergency that the Board’s Policy #14 provides for the refill of certain medications for up to 30 days for persons in the areas covered by the State of Emergency.

Indiana

As a result of the passage of legislation earlier this year that NACDS supported, HB (House Bill) 1568 allowing pharmacists who meet certain requirements to prescribe and dispense hormonal contraceptive patches and self-administered hormonal contraceptives, CMS approved the SPA (State Plan Amendment) giving pharmacists the ability to bill Medicaid for services associated with the prescribing of hormonal contraceptives.

Also in Indiana, the Family and Social Services Administration (FSSA) recently issued several Indiana Health Coverage Program (IHCP) bulletins of interest to pharmacies, including pharmacy updates approved by the DUR (Drug Utilization Review) Board, enhancements to the fee-for-service prior authorization submissions process and changes to the submission requirements for the FFS (Fee For Service) claim administrative review process. IDPC also provided new portal links to providers webpage. 

Also in Indiana, Cora Steinmetz, JD, is the new Medicaid Director, Family and Social Services Administration (FFSA). Previously, she was Senior Operations Director for health-related state agencies for Gov. Eric Holcomb (R).

Louisiana

The new Single Pharmacy Benefits Manager (PBM) for Medicaid Managed Care will start on October 1, 2023. Magellan Medicaid Administration (MMA) will process all Medicaid managed care organization (MCO) pharmacy claims.

 Also in Louisiana, state elections will be held this fall. The Primary will be held on October 14, and the General election will be on November 18. Tim Temple (R) is now running unopposed for Insurance Commissioner now that political newcomer Rich Weaver, dropped out of that race. 

Also in Louisiana, starting on October 1, LDH will reimburse pharmacies for glucose monitors and diabetics supplies, and add diabetic supplies to the Medicaid Single Preferred Drug List to have one list of preferred/non-preferred products. As of December 1, 2023, diabetic supplies will be limited to pharmacy claims only. 

Finally in Louisiana, the next scheduled meeting of the Council on Medicaid Pharmacy Reimbursement is on September 13.

Minnesota

The Department of Human Services released the 2023 Cost of Dispensing Survey Report that recommends an 0.78 increase in the FFS PDF for all retail pharmacies. I understand the General Assembly would have to pass legislation to implement it. NACDS intends to work with members and in-state partners on this in the next legislative session.

Missouri

The Missouri Board of Pharmacy released emergency rules regarding pharmacist vaccine administration, effective August 28, 2023. The rules establish guidelines for independent vaccination by pharmacists, for vaccines approved as of January 1, 2023, as well as provide guidance for vaccines administered under protocols. They also clarify that pharmacists may continue to administer vaccines that are periodically/annually reformulated or updated, such as seasonal influenza vaccines, if the FDA approved the original vaccine before January 1, 2023.  

The Board issued a Supplemental Pharmacy Practice Guide summarizing the 2023 legislative changes.

The Nebraska Department of Health and Human Services announced new income guidelines have increased the number of families who could qualify for the Women, Infants, and Children (WIC) nutrition assistance program. Some families who were not eligible for the program in the past may now qualify. Current Medicaid, SNAP (Supplemental Nutrition Assistance Program) or ADC recipients are income-eligible for the WIC program. All foster children under five years of age and pregnant teen moms in foster care are income-eligible for WIC.

Ohio

The Board of Pharmacy published a bulletin complying with the new regulations effective on September 1 that authorize technicians to administer immunizations.  

Also in Ohio, Medicaid (ODM) announced new Professional Dispensing Fee Rates in both the SPBM (Single PBM) and Fee-for-Service programs. The increases in the SPBM Managed Care program will be effective September 1, 2023. Since SPA approval is needed for the Fee-For-Service program, ODM projects that implementation would be effective on January 1, 2024. 

Also in Ohio, the Board of Pharmacy has proposed the following rules for stakeholder feedback: 

  • 4729:5-3-21 – Continuous Quality Improvement Programs in Pharmacy Services. (NEW – Applies to Outpatient and Institutional Pharmacies)

The Board of Pharmacy adopted Chapter 15 approved rule allowing pharmacy technicians to administer immunizations, effective September 1, 2023.  

Also in Oklahoma, Gov. Kevin Stitt (R) appointed Ellen Buettner as the new CEO of the Oklahoma Health Care Authority (OHCA) which oversees Oklahoma's Medicaid program. She had served as Chief of Staff since 2019. 

Finally in Oklahoma, the Oklahoma Pharmacists Association's (OPhA) annual convention was held in Oklahoma City last weekend where the President of Osborne Drugs, Bill Osborn, was sworn in to serve as the President of OPhA.

Oregon

Gov. Tina Kotek (D) signed HB 2725 (Chapter 509), legislation prohibiting PBMs (Pharmacy Benefit Managers) from retroactively denying or reducing payment on a claim after adjudication unless the pharmacy and PBM agree that payment was incorrect due to clerical error. It also prohibits PBMs from imposing fees on pharmacies after point of sale. It also requires a PBM, if denying or reducing reimbursement on a claim, to provide notice to pharmacy of specific claim that is denied or reduced and detailed explanation for denial or reduction. This measure was effective upon passage. 

Also in Oregon, the Oregon Health Authority has posted new protocols for the following vaccines: RSV (Respiratory Syncytial Virus), Influenza (IIV 2023-24 – Interim), and Influenza (LAIV 2023-24 – Interim). An interim protocol will be replaced with a final protocol once the ACIP (Advisory Committee on Immunization Practice) recommendations are published in the MMWR (Morbidity and Mortality Weekly Report). Also, the following protocols have been updated: HPV vaccines (9vHPV) and Meningococcal A, C, W, T and B.

Gov. Bill Lee (R), Department of Economic and Community Development Commissioner Stuart C. McWhorte, and The Kroger Company officials announced that Kroger will be constructing its fifth U.S. Central Fill facility in Cleveland, TN. Rep. Kevin Raper (R-Cleveland) stated, “…This endeavor will create 140 jobs and provide state-of-the-art care through the utilization of automated technology to fulfill prescriptions. We are honored to be the site for this project, and highly anticipate the positive impact it will have on our economy and community.”

Texas

On September 1, 2023, more than 770 new laws passed by the legislature go into effect, including Senate Bill 29 that bans the state from enacting mask mandates, vaccine mandates or business and school closures to prevent the spread of COVID-19. The law makes exceptions for certain entities, such as prisons, hospitals and assisted living centers or nursing homes. 

Also in Texas, NACDS sponsored the Passing of the Gavel ceremony where HEB pharmacist Jay Bueche was sworn in as president of at the Texas Pharmacy Association's (TPA) Convention and Expo in Houston.

Alabama

The Board of Pharmacy and the Board of Medical Examiners held a Joint Committee meeting to discuss the issue of test and treat in community pharmacies. Both Boards have made the decision to begin the rulemaking process to amend our rule to allow for test and treat under certain conditions. The Department of Regulatory Agencies (DORA) will hold a stakeholder webinar at 1:00 p.m. MT on August 21 to discuss several proposed rules, including: 

  • Rule 23.00.70 – ELECTRONIC PRESCRIPTION MONITORING PROGRAM – Release of PDMP (Prescription Drug Monitoring Program). Information – The purpose of the proposed amendments to Board Rule 23 is to reflect feedback from several stakeholders and board members to clarify records requests for deceased individuals. 
  • Rule 3, 11, 17, 20, and 21 – DISPENSING, RECORDS AND RECORDKEEPING, COLLABORATIVE PHARMACY PRACTICE, CENTRAL PRESCRIPTION PROCESSING, and COMPOUNDING – The purpose of the proposed amendments to Board Rule 3, 11, 17, 20, and 21 are to reflect feedback from several stakeholders and board members to bring our rules up to date with digital technology and other outlet protocols and other recordkeeping means through digital formats.

During this year’s legislation session, Connecticut Public Act 23-19 was passed, and pharmacists are now allowed to vaccinate children ages 12 years and up. Regulations are expected to be adopted by the Department of Consumer Protection, in consultation with the Commissioner of Public Health and the Commission of Pharmacy. While regulations and legal questions are worked through, the Department of Public Health (DPH) Immunization Program would like to assist you with enrollment in the Connecticut (Pediatric) Vaccine Program (CVP). Per CGS Sec. 19a-7f, all vaccines administered to children in Connecticut available through the CVP must be procured through the Immunization Program.

Illinois

HB 3203, legislation that authorizes pharmacists or retailers to sell fentanyl test strips over the counter and authorizes county health departments to distribute fentanyl test strings at their facilities for no fee was signed by Gov. JB Pritzker (D) on August 4th and goes into effect January 1, 2024.  

Also signed by Gov. Pritzker (D) on August 4th was HB 3631, legislation that prohibits a pharmacy benefit manager (PBM) from retaliating against a pharmacist or pharmacy for disclosing information in a court, administrative hearing, before a legislative commission or committee, or any proceeding, if the pharmacist or pharmacy has reasonable cause to believe that the disclosed information is evidence of a violation of state or federal law, rule or regulation. The bill also prohibits a PBM from retaliating against a pharmacist or pharmacy for disclosing information to a government or law enforcement agency, if the pharmacist or pharmacy has reasonable cause to believe that the disclosed information is evidence of a violation of state or federal law, rule, or regulation. A pharmacist or pharmacy must make reasonable efforts to limit the disclosure of confidential and proprietary information. This measure went into effect July 1, 2023.  

Also in Illinois, the Illinois Department of Healthcare and Family Services (HFS) has issued notice that implements Public Act 102-1051 which allows pharmacists to be reimbursed for human immunodeficiency virus (HIV) pre- and post-exposure prophylaxis assessment and consultation. This new policy is effective with dates of service on and after January 1, 2023, and applies to the Medicaid fee-for-service (FFS) program and the HealthChoice Illinois (HCI) managed care organizations (MCOs). 

In accordance with the Act, the Department of Healthcare and Family Services (HFS) will cover patient care services provided by a pharmacist for HIV pre- and post-exposure prophylaxis assessment and consultation at 85% of the physician rate. Pharmacists must have a standing order with an associated physician, be licensed to practice medicine in all its branches and be enrolled in the Illinois Medical Assistance Program to perform the assessment and consultation services.  

HFS has also issued notice informing pharmacies that HFS has opened additional procedure codes that may be billed for pharmacists providing hormonal contraceptive assessment and consultation services. This applies to the Medicaid fee-for-service (FFS) program and the HealthChoice Illinois (HCI) managed care organization (MCO) plans. 

By provider notice dated October 31, 2022, the Department of Healthcare and Family Services (HFS) notified providers that patient care services provided by a pharmacist for hormonal contraceptive assessment and consultation would be covered at 85% of the physician rate. HFS identified CPT procedure code 99401 – Preventive medicine counseling and/or risk factor reduction intervention(s) provided to an individual (separate procedure); approximately 15 minutes, for billing. Modifier FP must be billed in conjunction with procedure code 99401.  

Effective retroactive to August 1, 2022, pharmacies may bill on behalf of pharmacists for one of the following Evaluation and Management procedure codes with the FP modifier, in addition to 99401, for the assessment component of the family planning service. 

HFS has been notified of an extreme shortage of Cisplatin, which has been determined to constitute a medical emergency for those patients in need. In accordance with the actions by the Food and Drug Administration (FDA), a non-FDA approved Cisplatin, manufactured by Qilu Pharmaceutical Company in conjunction with Apotex Corporation, can be distributed into and within the State of Illinois and will be reimbursable for Illinois Medicaid enrolled providers. Finally in Illinois, Snap EBT (Electronic Benefit Transfer) data theft has been on the rise in stores across the Country. The Department of Human Services (IDHS) has confirmed a recent surge in compromised cards in Illinois. Retailers are urged to immediately contact their POS (Point of Sale) vendor, local police, FNS and IDHS if skimming devices are discovered, or your pin pads have been compromised in any way. With prompt notification, IDHS can move to protect cardholders before their benefits are stolen. Tracking skimming after the theft is exceedingly difficult to do.
