The 2023 General Session of the 67th Wyoming Legislature adjourned on March 3.  

The following bills were signed into law by Gov. Mark Gordon (R): 

  • SF 7 (Enrolled Act No. 36), legislation amending the definition of "opiate antagonist" to mean any device or medication approved by the U.S. FDA for the treatment of an opiate drug related overdose effective immediately upon completion of all acts necessary for a bill to become law. 
  • SF 9 (Enrolled Act No. 53), legislation authorizing payment for services rendered by a licensed pharmacist under the Medical Assistance and Services Act effective July 1, 2023.

This week, a call for topics for the 2023 joint interim committee was announced with a deadline of February 24 at 4:00 p.m. Requested topics may originate from any source but should be submitted or sponsored by a legislator and presented to the committee by a legislator. Submissions must be made using the online form. Questions regarding the submittal of the interim topic request form may be directed to Kelly Lower.

On March 7, Gov. Mark Gordon (R) signed SF 24 (Chapter Number 7), authorizing the administration of immunizations by pharmacy technicians and pharmacy interns. It also eliminates the statutory definition of “direct” supervision requirements for pharmacy technicians and pharmacy interns, leaving the “supervision” requirements to be further specified by the Board of Pharmacy.

Also in Wyoming, on March 15, Gov. Mark Gordon (R) signed SF 101 (Chapter Number 69), permitting pharmacists to prescribe an opiate antagonist in accordance with the Emergency Administration Medical Treatment Act. It also directs the Board of Pharmacy, in cooperation with the Board of Medicine, to adopt rules delineating the requirements a pharmacist must need to prescribe an epinephrine auto-injector.

Effective June 16, the Board of Pharmacy amended regulations under Chapter 16 adding vaccines approved by the US Food and Drug Administration for COVID-19 and allowing the administration of vaccines to children and healthy adults in accordance with current Centers for Disease Control and Prevention recommended vaccine schedules.

The Board of Pharmacy issued the following effective May 13.

  • Final rule amending regulations under Commissioner of Drugs and Substances Control Chapter 10 to revise standards for issuing and dispensing prescriptions for controlled substances. The rule exempts from electronic prescribing requirements any controlled substance prescriptions that are to be dispensed from a pharmacy within federal jurisdiction.
  • Final rule amending regulations under Chapter 17 to revise standards for sterile compounding to reflect industry standards. The rule updates definitions specify pharmacy staff training and evaluation requirements and addresses garbing and facility controls.

Also in Wyoming, the Office of the Attorney General issued a final rule amending regulations under Schedule II Controlled Substances, Chapter 1, to add the fentanyl precursor 4-anilino-N-phenethyl-4-piperidine (ANPP) to the list of Schedule II controlled substances effective May 13.

The Board of Pharmacy’s emergency rule amends regulations under Chapter 16 to clarify standards for pharmacists to provide immunizations during the COVID-19 public health emergency. The rule removes the definition of “private space” and the requirement that the individual receiving a vaccine be seated in a chair with back support. The rule also adds vaccines approved by the FDA under the Emergency Use Authorization for COVID-19. The rule extends December 9, emergency rule and became effective April 7, and expires August 5, 2021.

The Board of Pharmacy published a proposed rule to revise Chapter 16 of the Wyoming Pharmacy Act Rules to include the COVID-19 vaccines, ease requirements for administering vaccines, and update the incorporated CDC recommended vaccination schedules.  The proposal currently is in effect as an emergency rule, expiring April 8, 2021. Comments are due May 8, 2021.
